Texas Dog Bite & Animal Attack Attorney

Dogs and other domesticated animals can be wonderful companions, but they can also be extremely dangerous for other people. Vicious dogs can cause serious and disfiguring injuries. Owners of dangerous dogs or other pets who fail to take the adequate steps to protect other persons must be held responsible for damages caused by these animals.

If you or someone you care about was attacked by someone else’s pet, you likely have the right to recover compensation. You have the right to hold the responsible parties liable for your injuries and the harm suffered by you and your family. The dedicated animal attack injury attorneys at the Gilbert Adams Law Offices are ready to fight for your right to compensation. We’ll help you secure the damages you are owed from pet owners, pet sitters, and any other parties responsible for the harm you have suffered.

Texas Dog Bite Rule

Different states have different rules about how and when pet owners, especially dog owners, may be liable for injuries caused when their pets attack. In some states, injured animal attack victims must prove either that the pet owner did something negligent–such as by letting the dog off the leash in a public area–or that the animal was known to be dangerous, or both. In other states, dog owners are automatically or strictly liable when their pets attack someone, even if they took every reasonable precaution.

In Texas, it is a common misconception that pet owners benefit from the “one bite” rule. However, where the owner knew or should have known that the pet was dangerous or had a disposition or propensity to bite or attack others and the owner failed to exercise ordinary care, then the owner is responsible for the damages caused thereby.  Oftentimes, homeowner’s insurance is required to cover the damages caused by the dangerous pet.

If the dog has bitten someone before, however, or otherwise has a history of behavior suggesting that the dog is dangerous and aggressive, then the owner could be held strictly liable. That means that you can recover compensation from the owner even if the owner was taking precautions in trying to prevent their dog from attacking. Proving that an animal was known to be dangerous in order to benefit from the strict liability rule can be a tricky prospect that requires the knowledge and skill of an effective Texas dog bite lawyer.

If you can show the owner was negligent or that the dog was dangerous, you can collect damages for your injuries, pain and suffering, loss of income, and other harm. If the dog was trained to attack others, you might be awarded punitive or exemplary damages.
